iPhone Developer Accused of Using Games to Harvest Phone Numbers

At the risk of making this story sound like one of those annoying local advertisements for personal injury attorneys, here it is: If you or someone you love recently purchased and played an iPhone game from developer Storm8, such as iMobsters or Vampires Live , it appears your phone number may have been collected without your consent. Or, at least, that's what Lynnwood, WA resident Michael Turner is accusing the company of doing in a class action lawsuit he recently filed ( BoingBoing , via Joystiq ). According to the lawsuit, Storm8 is accused of exploiting an "electronic backdoor" with the use of "malicious software code" in their games to collect phone numbers without the iPhone owners knowing, and without the authorization of Apple. Activision 'Not Overly Concerned' With Modern Warfare 2 PC Backlash

When Activision announced their IWNet matchmaking service will replace dedicated servers for the PC version of Modern Warfare 2 , it predictably angered a lot of PC gamers. But apparently when you're dealing with what's already been anointed as the likely-to-be best-selling game of the year, angering some of your customers isn't too much to worry about. "We're, of course, watching this very carefully and paying attention to it," said president Mike Griffith during an earnings call ( via Kotaku), in response to a question about whether the backlash could affect sales. "But we're not overly concerned about it." Why? As Griffith explains, he's confident the IWNet service will add enough benefits to overcome the backlash. "One of the problems with our PC SKUs in the past is that it has not been as friendly a consumer experience in terms of matchmaking and online play as the consoles have allowed it to be," Griffith said. ...

Tales of Vesperia Coming to Wii?

While Nintendo has received a lot of love from Namco's Tales Studio in recent years, Tales of Vesperia - perhaps its best RPG of the generation, has been left off of the Wii Wagon. While the game was extremely popular on 360, it has recently been ported to the PS3 in Japan...and now, it could be heading for the Wii too. The rumor comes from voice actor Rikiya Koyama, who plays Duke in the game. In a post on his blog, he states that the game is coming to the Wii in some form - but whether it's a port or a spin-off is unknown. Based upon the meh-ness of last time, let's hope for the former.

North American Final Fantasy XIII Release Date Coming Soon?

While Final Fantasy XIII is set for a PS3-exclusive release in Japan next month, the bigger question has been when Square Enix would announce a release date for its multiplatform overseas release. However, Square Enix CEO Yoichi Wada revealed in an earning conference last week, translated by PS3center.net, that the international release of FFXIII is "progressing smoothly", and could be out before the end of the fiscal year in North America and Europe. That's "by April" in industry speak. Okay, so now we know when the game could be coming out, but the question remains...when will we get our release date? Well, that question may have been answered as well.

Gyromancer Coming to XBL and PC Nov. 18

PopCap and Square Enix have announced that Gyromancer , the result of their collaboration to make a game combining Bejeweled Twist and the general experience and level-gaining elements of a Final Fantasy , is set for release on Xbox Live Arcade and PC on November 18 ( via Shacknews). If "a cross between Bejeweled and Final Fantasy" sounds familiar to you, then you've probably heard of or played Puzzle Quest . PopCap and Square Enix don't really seem to be hiding the fact that Gyromancer will be a direct competitor to the popular puzzle/RPG hybrid, though, so it'll be interesting to see if the higher profile names attached to it help Gyromancer catch up to the surprising success of D3 Publisher's franchise. If you're interested, the game will run you 1200 Microsoft points or $15 dollars.

New Zelda Wii Not 'Committed' to 2010 Yet

For a company that's long been notorious for delaying their games, is it any surprise to see they'd be cagey about committing to anything so early in a project's development? Speaking to Geoff Keighley on the latest episode of GameTrailers TV, Nintendo of America president Reggie Fils-Aime was very deliberate in not setting a release timeframe for the new Legend of Zelda in development for the Wii. "We haven't committed to Zelda in 2010," Reggie elusively said. Keighley clarified that Miyamoto has so far said the game is "tracking" for 2010. "That's what he said, and we'll see how that continues to develop," retorted Reggie. He did, however, reconfirm that Super Mario Galaxy 2 and Metroid: Other M are committed to 2010, so that's at least two big titles to look forward to next year, Wii fans. Well PS3 owners, the wait is finally over; Netflix is officially here for Sony's console. I'm sure those of you who are on top of things requested the disc when it was first announced and have probably already recieved it in the mail. In that case, the video below is undoubtedly old news for you. For others like myself that were slow in resquesting the streaming enabled disc, the following clip provides a first look at the system's setup for instant watch (courtesy of 1UP). You'll notice that while the software could definitely use some updating in the future, the video quality is absolutely spectacular. Impressions? Opinions?

Nintendo on Super Mario Bros, Digital Gaming

The October 30th corporate Nintendo briefing was packed with information on the future of Nintendo. The HD future, hardware and issues on software were all mentioned in the full briefing found here. Satoru Iwata and Shigeru Miyamoto specifically mention the upcoming New Super Mario Bros Wii game, a brief reference to DS titles, and quite a bit on the Internet and gaming. According to Miyamoto, the multiplayer aspects of the upcoming Super Mario Bros title were only made available by the Wii's unique hardware. "On every Mario project we have discussed the possibility of having two players play together simultaneously," Miyamoto said. "This time the screen zooms in and out accordingly, thanks to the capacity of the Wii console. The camera can zoom out as far as three times wider where you can see a very small Mario running around, and zoom in to show huge Mario and Luigi." Dhani Harrison: Rock Band 3 will Teach You to Play Music

Dhani Harrison, son of the Beatles' late George Harrison, works as a consultant for Harmonix on the Rock Band series. He worked on the original Rock Band, and naturally helped produce The Beatles: Rock Band. "I guess I'm accidentally responsible for 'Rock Band' becoming the Beatles digital platform, but it was a no-brainer," he told the Chicago Tribune. "It's really difficult to get the Beatles to agree on anything, but I set up demos for them, and [music executive and Beatles friend] Neil Aspinall instantly saw the potential." Now Harrison is working on the inevitable Rock Band sequel. "I'm working on 'Rock Band 3' and making the controllers more real so people can actually learn how to play music while playing the game," he said. "Give me a couple years, it's going to happen." It's one thing to send Tales of Vesperia to the PlayStation 3, but how about the Wii? That may be exactly what happens, as popular Japanese voice actor Rikiya Koyama has reportedly leaked the news that Namco-Bandai is planning on porting the game once again (via Kotaku ). "Tales of Vesperia is coming out on one thing after another: Xbox 360, then PS3, and now upcoming, goes on sale even on the Wii," he wrote on his . "More shortly, the feature film anime version is also opening in theaters (But I'm not in it...), and after that, there's also a CD."
