Datel Sues Microsoft For Disabling "Unauthorized Devices" On Xbox 360s, Microsoft Won't Comment Yet

Accessory manufacturer Datel is calling Microsoft out. In October, Microsoft announced the next dashboard update would eliminate support for "unauthorized devices," essentially removing compatibility with memory units that weren't manufactured by Microsoft. As the only notable company producing memory units besides Microsoft, this directly impacted Datel's bottom line. Microsoft told G4 the reason for the change arose from consumers using the devices to cheat.
In a 21-page lawsuit filed against Microsoft, Datel claims that Microsoft told the company its devices would no longer work on Xbox 360s because of an "unintentional effect" of the latest dashboard update. Referencing the story that appeared here , Datel noted that's not what Microsoft told me.
"Microsoft goes to great lengths to protect the Xbox 360 and Xbox LIVE service from cheating, which is the primary purpose and use of these unauthorized MUs [memory units]," said the spokesperson at the time. ...

Find more top gaming news, videos, and blogs on GamerBlips: Gaming, Microsoft, Xbox, Xbox 360

Microsoft Files User-Created Game Guide Patent

New Super Mario Bros Wii has gotten a lot of attention for its Super Guide feature, but apparently Microsoft has been planning a similar helping hand for a year. Siliconera reports that the company's game platform strategy director Andre Vrignaud has filed a patent for user-submitted game guides over Xbox Live. According to the patent, the system detects where a player is stuck, and accesses a database with user-made tips for that section. Given the innate desire of experienced gamers to brag, and the inconvenience of stepping away from your TV to access a FAQ, it seems like a win-win. And since it would be controlled through the Xbox Live interface, Microsoft wouldn't have to manage a new guide for every individual game.

The authoring features allow users to capture screenshots and video clips, and to use a digital pencil to mark them. It also may allow for audio commentary and tags, and developers can submit their own ...

Find more top gaming news, videos, and blogs on GamerBlips: Gaming, Microsoft, Xbox

Morning Hangover -- What's Your Thanksgiving Travel Game?

Welcome to Morning Hangover -- an excellent way to start your day with the crew at TheFeed...no matter what you're recovering from. Every morning you'll hear musings from our editors and have the chance to share your thoughts on what's going on in the gaming world.

Many of us (yours truly included) will be spending a significant amount of time at the airport over the coming week. It's a time to pretend Xbox Live and PlayStation Network don't exist and get reacquainted with the DS and PSP. What game will be occupying your time over the Thanksgiving holiday? I'll be hopefully checking out Mario & Luigi: Bowser's Inside Story . My last experience with the series ended in tears, as a battery error resulted in a saved game with dozens of hours of progress being erased. I haven't been able to develop the courage to return...until now. It's been long enough.
The pain....has healed.

Some 2 million Xbox Live users have logged into Facebook since it launched over the service on November 17, Microsoft says -- which means about 10 percent of the total userbase has tried the new feature. Discussing early indicators of strong performance for its social networking features with CNet, Microsoft also said that Xbox Live users have created half a million Last.fm accounts in the first 24 hours. Spokesperson David Dennis did not provide specifics ...

News: Datel sues Microsoft over mem unit ban

Attacks "predatory conduct" in lawsuit. Datel has filed an antitrust lawsuit against Microsoft after the Xbox 360 platform holder's most recent dashboard update disabled support for third-party memory units. The complaint, filed in San Francisco federal court by Datel's representatives Howard Rice, accuses Microsoft of "exclusionary, predatory, or anticompetitive acts". It also dismisses the company's official explanation for the patch - that third-party memory units can be used to cheat on Xbox Live - as a "pretext" for establishing a monopoly on third-party accessories.
Xbox 360 | Datel suing Microsoft over memory-unit lockout

British maker of high-capacity, low-price storage units takes legal action against software giant, accusing it of antitrust violation.
In October, Microsoft revealed that the fall Xbox Live Update would lock out what director of programming Larry "Major Nelson" Hryb termed " unauthorized Memory Units ." Though not mentioned by name, the company most affected by the move was Datel, which sells Xbox 360 Memory Units with both higher capacities and lower prices than those made by Microsoft.

Datel's 2GB and 4GB memory cards were locked out by Xbox Live's latest update.

Now, just days after the Xbox Live Update went live , Datel has fired back at Microsoft--in court. This morning, the law firm of Howard, Rice, Nemerovski, Canady, Falk, & Rabkin announced it had filed a lawsuit in a San Francisco federal court on behalf of the UK-based peripheral maker.

Submitted late Friday, the suit accuses Microsoft of ...

Find more top gaming news, videos, and blogs on GamerBlips: Gaming, Microsoft, Xbox 360, Xbox

Random Video of the Day 2: Hot, Crazy Girlfriend Smashes Xbox

There is undoubtedly a lesson to be learned from the following video. The first would be "it is best to have a girlfriend who also enjoys video games."

Of course, that's easier said than done. Then again, some would argue the same could be said for a gamer having a girlfriend in the first place, but I digress.

With that in mine, should you find yourself in the position of having a girlfriend who does not like video games, it is advised that you make sure you're giving them enough attention:

"She must be having her monthly red ring of death," says CollegeHumor.

Something tells me that a warranty isn't going to cover that. Maybe he'll luck out and get a sympathetic customer service rep or technician.

Either way, I wonder if that relationship is long for this world. He seems to be taking it better than I would, at any rate.

Find more top gaming news, videos, and blogs on GamerBlips: Gaming, Xbox

Western Bayonetta Demo Fully Available Next Week

After a few previous opportunities, the demo for the upcoming Bayonetta will be available to everyone in western territories with next week's console store updates. No changes have been mentioned from the demos previously made available.

The last two times the Bayonetta demo was made available users had to jump through a few hoops to get it. In the beginning of October prior to the game's October 30th release, the demo was made available on Xbox Live and Playstation Network in their Japanese regions. Many western users got the demo with Japanese accounts and you still can if you don't want to wait another week.

The first official availability of the Bayonetta demo in the west was with a promotion that offered the chance to win the demo on Xbox Live to subscribers to Sega's newsletter. The promotion ended on November 13th and wasn't available on Playstation Network however.

December 3rd will be the first official release of the Baoynetta demo in the west for PS3 owners or anyone who didn't want ...

Find more top gaming news, videos, and blogs on GamerBlips: Gaming, Bayonetta, Xbox, Sega, PS3

Bayonetta Demo Coming December 3rd

The demo version of Bayonetta has been confirmed for a December 3rd launch, so all systems are go for gamers looking for a looped-out action title where a hot chick shoots dudes with guns built-in to her high heeled shoes. The demo will be out on both Xbox Live and the PlayStation Network.
Sega, Bayonetta's publisher, says the game is poised to become "one of the all-time benchmarks in action gaming," but Sega is understandably biased. The foreign game press, however is less biased and has generally been raving about this one. But read our own Sterling McGarvey's early impressions. for more info... and If you'd rather not read, that's cool too. Watch the first 15 minutes of gameplay from the full version of the game. It's in the video you see embedded below.

Amid Class Action Suit Reports, Microsoft Defends Xbox Live Modded Console Bans

As it responds to a law firm's attempt to gather petitioners for a class action suit, Microsoft is claiming the number of Xbox Live bans has been over-reported, and defends its efforts to combat piracy. Last week, consumer site IncGamers noticed that law firm Abington IP was seeking information from users who had their Xbox Live accounts suspended by Microsoft because of their modded consoles. Abington's outreach prompted numerous media reports suggesting that a class ...

News: Microsoft: "It wasn't a million" bans

Reports of modders' demise exaggerated. Microsoft's Marc Whitten, general manager of Xbox Live, has denied the recent reports that Microsoft banned one million modded 360s from the online service. "We didn’t release the number. I cannot explain to you why people would think it was a million people. It wasn’t a million people," Whitten told VentureBeat. "Check the veracity of that claim. It was one news source." That source was InformationWeek, which said two weeks ago that Microsoft banned "as many as one million" consoles that had been modified to play pirate games from Live. The claim was widely repeated, including by the BBC.
Microsoft Responds to Possible Class Action Suit Over XBL Bans

There's still a little fallout burbling over Microsoft's large wave of Xbox Live bans about two weeks ago, and at least one law firm smells the possibility of squeezing money out of it. Abington IP has announced that they're considering filing a class action lawsuit against Microsoft, and are urging those who were recently banned to contact the firm about joining the potential suit. Microsoft, meanwhile, has responded that they can ban pirates and modified consoles as much as they please.
"Piracy is illegal and modifying an Xbox 360 is a violation of the Xbox Live Terms of Use," a spokesman said to Financial Post ( via Kotaku). "Microsoft is well within its legal rights to ban these users from Xbox Live."
Some media reports initially suggested that bans totaled as high as between 600,000 and 1 million consoles, but Microsoft denied the upper level of those numbers. "I cannot explain to you why people would think it was a ...

Find more top gaming news, videos, and blogs on GamerBlips: Gaming, Microsoft, Xbox, Xbox 360

Right around last week's release of Call of Duty: Modern Warfare 2 , Microsoft issued a wave of Xbox Live bans, with some reports saying they totaled between 600,000 to as many as 1 million modified consoles. While the extent of the bans was certainly immense (a glance at Craigslist following the culling proved that conclusively enough), Xbox Live general manager Marc Whitten denies the number was as stratospheric as a million.
"We didn't release the number. I cannot explain to you why people would think it was a million people. It wasn't a million people," Whitten said in an interview with VentureBeat, where he also called the process of banning XBL users a "cat and mouse game."
"These were people that were pirating software," Whitten explained. "We try to keep sanctity of life from a safety and anti-cheating perspective and we protect our partners...I think we do a really good job understanding what people are doing on ...

Find more top gaming news, videos, and blogs on GamerBlips: Gaming, Microsoft, Xbox, Call of Duty: Modern Warfare 2

Law Firm Mulls Class Action Suit Over Modded Xboxes

You know all those Xbox Live users who were banned from the network recently for, apparently, connecting modified 360s to Live? Law firm Abington IP is considering filing a class action lawsuit against Microsoft on behalf of interested/eligible ban-ees.
Abington's website is looking for you if you:
"Are an Xbox Live subscriber, had your modified Xbox console banned from Xbox Live, were not refunded a prorated sum for the time left on your subscription or have experienced other problems as a result of being banned, and would like to participate in a class action against Microsoft"
The site also compares the mass-bannination to Microsoft using the "most indiscriminate 'weapons' in its arsenal in an effort to combat piracy," resulting in "a great deal of collateral damage."
I spoke to an attorney at Abington to get a little more info on the potential lawsuit, and he wasn't offering anything on-the-record about the potential suit, so it looks ...

Find more top gaming news, videos, and blogs on GamerBlips: Gaming, Xbox, Microsoft

Xbox 360 | Xbox Live ban class-action suit being mulled

Law fim puts out call for gamers tossed from Microsoft's online service in pre-Modern Warfare 2 purges.
In the error message displayed by as many as 1 million Xbox 360s reportedly banned from Xbox Live earlier this month , Microsoft told gamers that there was "no recourse" for violating the system's terms of use agreement. The intellectual property law firm Abington IP apparently disagrees, as it is looking for banned Xbox Live members interested in a possible class action lawsuit against Microsoft.

There is no recourse for Terms of Service violations…except maybe legal recourse.
The firm claims that Microsoft waited until the release of Call of Duty: Modern Warfare 2 to ban systems in order to maximize sales. The firm believes that sales of Modern Warfare 2, the recently released Halo 3: ODST, and overall Xbox Live subscriptions would all have suffered had the ban been instituted earlier.

In a statement, the GCHQ said that many of its recruitment criteria are "reflected in gameplay experiences on Xbox, such as quick thinking, problem solving, and teamwork." It is looking
to "fill around 250 predominantly IT and technical roles at graduate and professional level, many of which require specialist skills which are likely to resonate within the online community."

Since Microsoft instituted the "Deal of the Week" program on Xbox Live, there's always a thought that lingers each time I go to buy something on the Live Marketplace. I just know the following week is going to discount whatever it is I'm buying. More often than not I'm wrong, but it's still something I continue to think about. If you're the same way, you'll be interested to know what Microsoft has in store for the Deal of the Week for next week. Starting on November 23, the "See the Future" DLC for Fable 2 will be available for 400 Microsoft Points ($5), Peggle for 400 points ($5), and Death Tank for 800 points ($10). The following week, on November 30, Sonic the Hedgehog 2 will be available for just 240 points ($3).

As for the additions to the Games on Demand catalog for next week, you can expect to see Saints Row 2 and Lego Indiana Jones: The Original Adventures added on November 24.
British Government Recruiting Over Xbox Live

Gaming has been prospected as an armed forces recruitment tool for years, so it was only a matter of time before online games were targeted as an avenue. It's just that the British government ended up doing it first.

The Government Communications Headquarters (GCHQ) – a British intelligence agency working with the armed forces is initiating a recruitment drive over Xbox Live using in-game ads. The six-week campaign will target the 18-34 male demographic with streaming video banners and in-game ads. The effort will be led by GCHQ communications recruitment partner TMP Worldwide.

The first time GCHQ advertised over Xbox Live was its 2007 ad campaign for job opportunities in Splinter Cell Double Agent. The drive increased traffic to its website by over 500 percent.

The most famous gaming-related government recruiting tool has been the free America's Army games which seem to be proving legitimately effective.
